( KMZA )--A Beattie man has his probation revoked, and is sentenced to 43 months in prison on charges in connection with a traffic accident in 2010 that claimed the life of an elderly Sabetha man.
After several witnesses testified during a hearing Tuesday in Marshall County District Court, Ben O’Neil admitted to violating terms of his probation.
O’Neil was accused of violating his probation on June 13th by failing to abstain from the possession or use of alcohol, by not remaining in the state of Kansas and by entering a bar.
Authorities say O’Neil was driving a vehicle that crossed the center line of U.S. 36 near Beattie in July 2010 and struck a pickup truck driven by 88-year-old Milburn “ Bud” Cannon. Cannon later died from injuries received in the wreck. O’Neil’s vehicle also struck a car driven by Cannon’s wife, Lucylle, who was following behind her husband. She was also injured in the accident.
O’Neil was given a suspended prison sentence last September on two counts of aggravated battery and placed on 36 months probation. As part of the terms of his probation, he was ordered to serve 60 days in jail following a six month sentence on a charge of driving under the influence.
O’Neil’s probation began in late March after he finished his jail time.
