(KAIR)--The start of the re-trial for an Atchison County man previously convicted on murder charges has been pushed back.
58-year-old Kirk Wilson made an appearance in Atchison County District Court Tuesday for a pre-trial motions hearing. Wilson's attorney requested a change of venue for the trial, citing publicity surrounding the initial case, the subsequent appeals, and the upcoming re-sentencing of co-defendant Lisa Boldridge. The motion was denied, and after Wilson waived his right to a speedy trial, a continuance was granted, and a new trial date was tentatively set for January 12th. The continuance was granted in order to give Wilson's attorney more time to prepare for the case.
The trial was originally scheduled to start on September 29th, but a second round of pre-trial motions will be held on that date.
The Atchison County Court ordered a new trial for Wilson in 2013, in the March 2000 shooting death of 38-year-old Kurt Boldridge, saying that his counsel was ineffective. The state appealed the ruling, but it was upheld by a Kansas Court of Appeals panel in December of last year.
Boldridge was shot in the head with a shotgun as he slept at his rural Atchison home.
Lisa Boldridge's re-sentencing hearing is scheduled to commence on November 3rd.
