(KAIR) -- For a second time, a mistrial has been declared in the case against a rural Valley Falls man accused of attempted first-degree murder.
The jury was handed the case of John Hayworth, Junior around 10:30 Friday morning.
Jefferson County County Attorney Jason Belveal says at 4:30 the jury informed the Court that they could not agree on a verdict.
The Court found the jury was hung and declared a mistrial.
Further proceedings will be scheduled next week or thereafter.
Hayworth is accused of shooting William Schoonover in rural Valley Falls in December 2011. Schoonover later recovered.
Prosecutors allege that Hayworth fired the shot following an argument with Schoonover over cattle.
A mistrial was also declared last October due to the inadvertent showing of the wrong DVD containing evidence related to the case.
Charges related to the incident were also filed against Hayworth's wife, Bernadine. However, Belveal dismissed them in April.
