(KAIR) -- An Atchison man convicted of first degree murder will get a new trial.
A 49 page ruling by Atchison County District Court Judge Robert Bednar Wednesday overturns a 2001 conviction for Kirk Wilson.
In the ruling, Bednar cites improper use and investigation of available evidence by Wilson's then attorney, Michael Waite, which impaired Wilson's right to a fair trial in violation of the 6th and 14th amendments of the United State's Constitution.
Wilson was convicted in 2001 and sentenced to life in prison without parole for 25 years for the March 2000 murder of Kurt Boldridge.
He's made several attempts since that time to appeal the conviction, with the most recent attempt made in January.
Atchison County Attorney Gerald Kuckelman, who was not yet serving in his current role at the the time of the trial, has cited a conflict of interest in the case and has hand-delivered the ruling to the Kansas Attorney General’s office for appeal considerations.
Lisa Boldridge, Kurt Boldridge’s ex-wife, was sentenced to life without the possibility of parole for 50 years in February 2001 for her role in the murder.
Gary Skeen was sentenced to 14 years in June 2001 for conspiracy to commit first degree murder, while John Goodpasture, Junior, received two years of probation in June 2001 for conspiracy to commit aggravated burglary.
