(KAIR) -- A 42-year-old Atchison County man was deemed by the courts Monday incompetent to stand trial on aggravated assault related charges.
John Heaton will soon be sent to Larned State Hospital to undergo further evaluation and treatment.
A motion was filed by his attorney, Rex Lane last month to undergo a competency evaluation.
He was arrested by the Atchison County Sheriff’s Department on June 8th for allegedly pulling a gun on a Deputy and several individuals after a disturbance at a residence east of Atchison County Lake.
Atchison County Sheriff John Calhoon says Heaton then allegedly refused to drop his gun after repeated requests by the Deputy.
Eventually, Heaton complied and was taken into custody.
He faces two counts of aggravated assault and one misdemeanor count of criminal damage to property.
He remains in Atchison County Jail on 30 thousand dollars bond.
