A 35 year old Atchison man is still awaiting a competency evaluation to see if he’s fit to be charged on multiple counts.
The case was continued today in Atchison County Court until February 6th pending his release from probable cause for care and treatment for Gabriel Walls.
The order was made by Atchison County Judge Martin Asher January 13th.
This came following incidents which the Atchison County Jail Captain reported to the courts that he couldn’t make his next appearance on felony charges of burglary, theft and conspiracy to commit theft, as well as misdemeanor theft and possession of drug paraphernalia due to "psychotic issues."
Another person allegedly involved and charged with the same charges, minus the paraphernalia charge, is 20 year old Lynn Ball.
Due to Walls current situation, her status conference was delayed to January 27th.
The duo was arrested by Atchison police December 23rd for allegedly breaking into Walls’ mother’s home on December 18th and taking a generator and lawnmower.
They were given the new felony theft and conspiracy charges on December 30th for allegedly taking a generator from a residence in Potter.
Both remain in Atchison County jail with walls bond set at 15 thousand dollars and Ball’s at 10 thousand.
