Billington was recently convicted of felony theft and misdemeanor of a law enforcement officer.
He was arrested in early March by Atchison Police on a warrant for taking a laptop computer on February from Atchison Middle School when visiting his sister for lunch.
Upon his arrest sometime later, Billington resisted and was eventually taken into custody.
A delay in his case occurred after Billington’s attorney filed and then was granted a motion for a competency evaluation for Billington.
He was found competent to stand trial on July 23rd and sentenced to probation in August.
However with the new allegations, Billington could be subject for revocation of his probation.
He remains in Atchison County Jail awaiting bond and formal charges.
