( KAIR )---An Atchison County jury is to resume deliberations this ( Thursday )morning in the trial of an Atchison man accused of raping his pregnant next door neighbor.
The jury received the case of Kevin Simmons shortly after 1:30 Wednesday afternoon following closing arguments.
Around five, through a written request, the jury wanted a read back of specific testimony of five witnesses, which would take several hours of research by the court reporter.
After learning that information and being given the option to break for the evening by Judge Martin Asher, the jury decided to do just that.
Simmons faces two counts each of rape, aggravated sexual battery and aggravated burglary.
He is accused of entering the 40-year-old alleged victim’s residence on September 17th and October 6 of last year and sexually assaulting her. Authorities say she was eight months pregnant at the time.
The counts of rape were added following a preliminary hearing in May, which included testimony from the alleged victim, her husband and physician.
The trial began Tuesday in Atchison County District Court.
