Atchison Man Changes Plea in Battery Case

(KAIR) -- A 48-year-old Atchison man accepts a plea deal Friday after pleading not guilty Monday in Atchison County District Court.

Russell Vanwey pled guilty to the counts of domestic battery and attempted criminal threat.

In exchange, a misdemeanor theft charge was dismissed.

He was arrested July 30th at a local convenience store by Atchison Police after being located following a report of a disturbance earlier in the day where Vanwey allegedly struck his sister in the 1400 block of South 8th Street.

Vanwey also threatened his parole officer during that day, leaving a threatening voicemail at her office.

He could face five to 13 months in prison on the attempted criminal threat and up to six months with a minimum of 48 hours on the domestic battery.

It was announced in court that Vanwey’s prior record puts him in the “A” box, the highest rank of criminal history, so a prison sanction is possible, pending on a pre-sentence report.

Sentencing is scheduled for September 17th.
