Calhoon says Heaton then allegedly refused to drop his gun after repeated requests by the Deputy.
Eventually, Heaton complied and was taken into custody.
He was booked on two counts of aggravated assault and one misdemeanor count of criminal damage to property.
Calhoon says one of the agg assault counts will be a higher level felony since it was towards an officer.
He also says the investigation continues on if he will face more agg assault counts in formal charges.
Bond was set at 30 thousand dollars and Heaton remains in Atchison County Jail.
