Man Pleads Not Guilty to Burglary and Sex Charges

A 42-year-old Atchison man will head to jury trial on multiple burglary and sex charges.

Kevin Simmons pled not guilty to two charges each of rape, aggravated sexual battery and aggravated burglary Friday in Atchison County District Court.

Prosecution will present their case on September 18th.

Those counts allege that Simmons unlawfully entered the victim’s residence on September 17th and October 6th of last year and committed unlawful touching in a sexual manner by force to the woman that was eight months pregnant at the time.
 
In a preliminary hearing that spanned two days in late May, the rape charges were added by the County Judge after hearing testimony from the now 40-year-old female victim, the victim’s husband and her physician.

The testimony also revealed that Simmons was a neighbor and was friends with the victim’s husband during the time the alleged incidents occurred.

A pre-trial conference is set for August 27th.

Simmons is out on 75 thousand dollars bond.
