A 30 year old Atchison man has been deemed incompetent to stand trial on aggravated assault and felony theft charges.
Atchison County Court received documents deeming such after a competency evaluation was ordered for Matthew Billington last month.
He was arrested on March 3rd by Atchison Police on a warrant for allegedly taking items from the Atchison Elementary School on February 27th.
During the arrest, he allegedly threatened harm to the officer and himself before a brief struggle ensued before he was arrested.
As a result, he was given the charge of aggravated assault.
He will now be sent to Larned State Hospital for further evaluation.
