33 year old John L. Swenson of Auburn was sentenced to 40 – 50 years in prison by Nemaha County, Nebraska District Judge Daniel Bryan on Wednesday. Swenson was sentenced on a class II felony count of sexual assault in the first degree. On a class I misdemeanor charge of exhibit of obscene material Swenson was sentenced to serve one year in the Nemaha County Jail. The sentences are to run concurrently.
A pre sentence investigation revealed that Swenson had previously been sentenced to prison for a prior sexual offense. He was released from prison in January of this year after serving just over a year on a charge of attempted abuse of a vulnerable person.
Judge Bryan determined Swenson to be a predator, but not a violent offender and he must register as a sex offender for life. In addition he is subject to lifetime supervision.
Swenson will be eligible for parole after 20 years in prison and subject to discharge after 25 years.
In addition, he was assessed $1,228 in court costs.
