(KAIR)--Formal charges are filed against an Atchison man accused of firing a handgun into the ground after a disturbance at a north-side residence.

According to a release from Atchison Police Chief Mike Wilson, 35-year-old Kevin Love was arrested Friday on an Atchison County District Court warrant charging him with criminal possession of a firearm.

Originally arrested September 16 for unlawful discharge of a weapon after the gun was allegedly fired, the new charge, and arrest, follows a review of the case file by the Atchison County Attorney’s Office.

The alleged disturbance happened around 9:00 on the morning of September 16, with Atchison Police Officers called to the 600 block of North 2nd Street “to investigate a subject with a gun in the backyard of a residence.”

After they arrived, police learned that a disturbance had occurred at that location, and Love, walking outside into the backyard, “fired one round into ground with a handgun” before he left the scene.
He was located a short time later and taken into custody.
A handgun was recovered by police.

Following his arrest Friday for criminal possession of a firearm, Love was booked into the Atchison County Jail.
His bond is set at $10,000.
