( KNZA )-A jury trial will be set for an area newspaper publisher accused of sexual battery and phone harassment.
During a telephone status hearing Thursday, the attorney for Dana Foley of Wathena informed Magistrate Judge Roy Roper that the defense and prosecutors couldn’t reach an agreement on a plea deal offered last month by the defense.
A criminal complaint was filed in March by the Kansas Attorney General’s office charging Foley with five counts of sexual battery and three counts of harassment by telephone.
According to the complaint, the alleged offenses occurred between June 2008 and October 2011 involving three individuals.
Foley is the owner/publisher of the Horton Headlight and Kansas Chief.
