Jenkins Introduces "Right To Record" Legislation

(MSC News)--A bill is introduced by United States Congresswoman Lynn Jenkins which allows residents of all states to record both in person, and telephone conversations, with federal employees.

12 of the 50 states have in place what's known as “two party consent” recording laws. That means, both persons involved in the conversation must be aware that it's being recorded.

Existing federal law, and the rest of the states, including Kansas, Missouri and Nebraska, requires only one person, meaning the one doing the recording, to provide consent.

Jenkins' proposal would mean the federal one party consent law would apply to any conversation involving a federal agency employee, incluidng the IRS.

Currently, a provision in federal law states that one party recording consent only applies to the IRS in certain circumstances.

Additionally, the bill woud require federal agency employees, prior to both in-person and telephone conversations, to notify citizens of their right to record.

Jenkins is working with United States Senator Roy Blunt, of Missouri, to introduce companion legislation to the Citizen Empowerment Act in the Senate.
