Former Richardson Co Attorney Named in Lawsuit

(KTNC) - The former Richardson County Attorney is named as a defendant in a civil lawsuit filed in Richardson County District Court.

Shelby, Nebraska resident Jlee Rafert and her four daughters filed the complaint, alleging breach of fiduciary duty, against Robert Meyer on May 30th. 

According to court documents, Meyer prepared an Irrevocable Trust Agreement for Rafert in March 2009, and has served as the trustee since that time.  Three life insurance policies, totaling $8.5 million, were issued to the trust. Pursuant to terms of the trust, the complaint says Meyer was to collect the proceeds of the insurance policies, which were payable to him for the beneficiaries who were Rafert’s four daughters.

The lawsuit alleges that Jlee Rafert personally paid premiums totaling more than $400,000 for the life insurance policies, but the premiums were not forwarded to the insurance companies, causing the policies to lapse.  The plaintiffs say they first learned the policies had lapsed in August 2012.

The lawsuit asks that the trust estate and trust distributions be restored to what they would have been “if the trust had been properly administered.”

Also named in the complaint are Doug Merz and the Weaver and Merz Law Firm. 

Meyer has yet to respond to the complaint.  He was elected Richardson County Attorney in 2010 and resigned Tuesday.
