(KNZA)--A petition to repeal St. Joseph's city-wide smoking ban has failed to get the needed number of signatures.
City Clerk Paula Heyde told KQ2-TV the petition fell shortly by 809 signatures.
The petition needed 2,568 signatures.
Steven Peterman, owner of Peterman's Shamrock, submitted the petition last Friday.
Voters approved the ban last April, which bans smoking in all indoor public places. However, smoking is still allowed on the floor of the St. Joe Frontier Casino. Peterman has argued in the past that the ban is unconstitutional because it allowed for the casino exemption.
