Falls City Man Facing 60 Years in Prison If Convicted

(KLZA)-- 43-year-old Scott Hayes of Falls City is facing up to 60 years in prison if he's convicted on a charge of being a habitual criminal in Richardson County District Court.

In addition to the habitual criminal charge, Hayes is charged with two felony counts of terroristic threats.

Hayes entered a plea of "not guilty" to the charges on Tuesday. A jury trial is scheduled for November 12 and bond was continued.

Hayes is charged for events that occurred in May of this year in which he made alleged threats to David Clark and to Falls City Police office James Wasson.

The habitual criminal charge carries a minimum prison sentence of 10 years if convicted and a maximum sentence of 60 years. Hayes was convicted three times previously of crimes that resulted in his incarceration for periods of not less than one year.

In 1994 he was sentenced to 1-5 years for third degree assault of an officer. In 1998 Hayes was sentenced to concurrent 7-20 year prison stays on charges of first degree assault and being a felon in possession of a firearm. Finally in February of 2011 Hayes was given 24-60 months in prison for third degree assault of an officer.
