Hospital Suing Jackson Co Over Medical Bill

(KNZA)---A Topeka hospital has filed a lawsuit against the Jackson County Commission seeking payment of a nearly $40,000 bill for the medical treatment of an Arkansas man shot during the commission of a crime three years ago.

The Holton Recorder reports the suit was filed last week in Jackson County District Court by Stormont-Vail Health Care.

The suit contends the commission is liable for the cost of treatment the hospital gave Dustin Chism after he was shot by owner of a rural Holton residence during an aggravated burglary in June 2011.

The hospital alleges in the suit that the county is liable for the cost of Chism’s medical treatment since he was in the custody of the Jackson County Sheriff’s Department at the time of his hospitalization and didn’t have the resources to pay for his treatment.

The Commission in February of last year voted to deny the medical claim.

Chism was sentenced to 15 months in prison on a charge of aggravated burglary in the case.
