(KLZA) A plea agreement has been reached with two Falls City men charged with the negligent discharge of a pollutant into public waters without a permit.
According to a news release, Jerry McKim and Brian Palmer entered a plea of guilty in U.S. District Court in Omaha this week. The plea will be accepted at sentencing, which is set for August 19th.
McKim and Palmer are charged with negligently violating the Clean Water Act by dumping and causing the dumping of asbestos laden construction debris into a ditch leading to the Big Nemaha River and subsequently to the Missouri River.
Palmer was a director and McKim was an officer of Vision 20-20 Incorporated. The company was involved in the demolition of the Stephenson Motel in Falls City. The destruction of the existing motel involved the abatement/removal of asbestos from the roof and ceiling of the structure.
The dumping of the debris occurred between October 2010 and January 2011.
