Seneca Prepares to Take Legal Action for Right of Way

( KMZA )-- The city of Seneca is preparing to take legal action to obtain right-of-way needed for the Branch Street extension.

Seneca City Administrator Tami Haverkamp informed the city council Wednesday evening that Seneca Motel owner Dick Ayers has rejected two city offers for compensation for a 65 by 80 foot tract at the south end of his property needed for the street extension Ayers had until this past Monday to respond to the city's offers.

Following a closed-door session with City Attorney Martin Mishler, the council directed the city attorney to draft an ordinance for approval at their next meeting that would begin the eminent domain process.

The Branch Street extension will provide access to tracts on the former golf course that the city would like to develop.

In a related matter, the council voted to enter into an agreement with the Kansas Department of Transportation for the Branch Street extension and U.S. 36 improvements project.

KDOT will pay up to 2 million dollars of the construction costs. The city of Seneca is responsible for right-of-way procurement, utilities and pre-construction engineering.
