Eugene Kimmi Probation Revoked on DUI Charge

For a second time, the ex-husband of murdered rural Horton resident Patricia Kimmi has his probation revoked on a third offense DUI conviction.
Following a hearing today ( Monday ), Brown County District Judge John Weingart found Eugene Kimmi of rural Everest had violated a condition of his probation by testing positive for alcohol and ordered him to serve the balance of his original jail sentence, amounting to about 7 months.
According to testimony, Kimmi tested positive for alcohol after being tested by his probation officer on March 30th and tested positive again after being arrested April 2nd by the Atchison County Sheriff’s Department on a warrant for the probation violation.
Tests conducted by the Kansas Bureau of Investigation showed Kimmi had a blood-alcohol content level of .12 percent, which is above the legal limit of .08 percent.
 After having his probation revoked, Kimmi was remanded to the custody of the Brown County Sheriff to begin serving his jail time.
