An Atchison man will serve presumptive probation under the Senate Bill 123 drug rehab program.
Jesse Smith was given the program, suspended from a 13 month prison sentence on a felony marijuana possession charge Monday in Atchison County Court.
He was also given a 48 hour jail sanction as part a concurrent suspended six month jail sentence on a charge of domestic battery.
He was arrested by Atchison Police on November 19th for striking his ex-girlfriend at a local restaurant.
Officers discovered the marijuana on him during his booking.
As part of the sentence, he is to have no violent contact with the victim.
