KS: Let Courts Decide School Funding

WICHITA, Kan. (AP) - Kansas is urging the Kansas Supreme Court to let the governor and lawmakers decide whether schools are getting enough money.

Lawyers for the state argued in a brief Tuesday that if the court wants to make that decision, then the evidence students are excelling should convince it that the funding is sufficient.

Attorney General Derek Schmidt contends the Kansas school finance system satisfies the requirement for adequate funding in the state Constitution.

He urged justices not to allow a small number of districts to second-guess the Legislature's judgment.

The new school funding law took effect in April and scrapped the old per-student formula for distributing aid in favor of predictable grants for each district.

A lower-court panel invalidated parts of the school financing law enacted by the Republican-dominated Legislature.

Per the Constitution of the State of Kansas, ALL funding for education comes from the Kansas Legislature, NOT the courts. Article 6 Section 6: Finance. a The legislature may levy a permanent tax for the use and benefit of state institutions of higher education and apportion among and appropriate the same to the several institutions, which levy, apportionment and appropriation shall continue until changed by statute. Further appropriation and other provision for finance of institutions of higher education may be made by the legislature. b The legislature shall make suitable provision for finance of the educational interests of the state. No tuition shall be charged for attendance at any public school to pupils required by law to attend such school, except such fees or supplemental charges as may be authorized by law. The legislature may authorize the state board of regents to establish tuition, fees and charges at institutions under its supervision. c No religious sect or sects shall control any part of the public educational funds. OBEY the Constitution!

What part of OBEY the Constitution is too difficult to understand? I am sick and tired of government officials, at ALL levels, wiping their collective asses with both the US and State Constitutions. The US and State Constitution place direct LIMITS on government, specifically enumerating what government has the power to do. Instead of those obeyed limits, what We The People get from our government is uncontrolled usurped power with forced unconstitutional laws and regulations at EVERY level of government. Each and every time the government acts in a manner not specifically enumerated as a power of government, it is UNCONSTITUTIONAL! OBEY the Constitution!
