(KNZA)--An Ozawkie man accused of opening fire with a handgun while driving in Holton last month will be allowed to continue serving in the Kansas National Guard for now.

The Holton Recorder reports a judge recently granted a request on behalf of 23-year-old Joshua Joseph Myers to allow him to continue participation in Guard activities while his case works its way through the court system.

Myers is charged with attempted second-degree murder.

He’s accused of shooting a 9 millimeter handgun from his vehicle at another man who was standing across the street from him at the intersection of 5th and Arizona on October 23rd.  The alleged intended victim wasn’t hurt.

Myers was arrested about 10 minutes later in Denison after allegedly fleeing the scene.

A preliminary hearing in the case has been set for January 12th.

Myers is currently on electronically-monitored house arrest after being released on bond last month with certain conditions.
