(MSC News)--Documents related to the death of a 4-year-old Hiawatha boy must be turned over by the Department for Children and Families.
The Topeka Capital-Journal reports the ruling came Friday by U.S. Magistrate Judge Kenneth Gale, who rejected the arguments posed by DCF.
The agency wanted the investigative report related to 4-year-old Mekhi Boone, along with over a dozen other documents, to be kept secret. The agency has 30 days to comply.
The Judges decision comes as part of an ongoing federal lawsuit filed by the child's mother, which claims DCF should not have placed the child with his father, Lee Davis IV. He, and his live-in girlfriend, are both serving prison sentences related to the 4-year-old's death.
The ruling came on the heel's of a separate state lawsuit filed by the attorney for the child's mother seeking the release of related documents.
