(MSC News)--The 25-year-old Atchison man arrested Monday when he attempted to enter a U.S. House Office Building while in the possession of an unloaded handgun was released from jail on Tuesday.
RollCall.com reports a preliminary hearing for Joshua Wheeler, a summer intern for U.S. Congresswoman Lynn Jenkins, is scheduled for Thursday morning in the District of Columbia.
A D.C. Superior Court Judge has acknowledged that Wheeler misunderstood the District's gun laws.
Wheeler apparently has no criminal background.
According to his Facebook profile, Wheeler is a native of Ohio who began studying Political Science and Finance at Benedictine College in Atchison last year.
The Associated Press reports Wheeler was arrested Monday morning when he was found to have an unloaded 9mm handgun in his possession as he attempted to enter the House office building.
He was arrested for carrying a pistol without a license and possessing an unregistered firearm. RollCall.com reports that prosecutors did not pursue the misdemeanor unregistered firearms charge, but will prosecute for carrying the pistol, which is a felony.
Jenkins' office immediately placed Wheeler on temporary leave following his arrest, and he has been ordered by a Judge to stay away from the Capitol.
