(KLZA) 28 year old James Graves of Salem appeared in Richardson County District Court Tuesday for a hearing on a plea agreement on two amended charges of Sexual Assault in the First Degree, both of which are class II felony charges.
The State, represented by a special prosecutor with the Nebraska Attorney General’s Office, dismissed, with prejudice, 10 counts against Graves in exchange for his guilty plea to the two remaining charges.
The court found Graves guilty of the amended charges. Graves request to be transferred to the Nebraska Department of Corrections for a sex offender specific evaluation was approved. Sentencing has been scheduled for October 2nd and bond was continued.
According to court documents on or about January 10th of 2008 or within 10 days of that date, Graves being a person of at 19 years of age or older, subjected a person being more than 12 year of age but less than 16 to sexual penetration.
The charges dismissed included two more counts of sexual assault in the first degree; a pair of 1-B felony counts of sexual assault of a child in the first degree; a felony charge of terroristic threats; a felony charge of tampering with a witness and misdemeanor charges of stalking, domestic assault, attempted strangulation and criminal trespass.
A class II felony count is punishable by a maximum sentence of 50 years in prison with a minimum sentence of one year in prison.
