A 42-year-old Atchison County man facing aggravated assault charges will learn next week if he will undergo a competency evaluation.
John Heaton’s court appointed attorney, Rex Lane, filed the motion on his behalf Monday in Atchison County District Court.
A hearing will be held on motion next Monday, July 9th.
Heaton was arrested by the Atchison County Sheriff’s Department on June 8th for allegedly pulling a gun on a deputy and several individuals after a disturbance at a residence east of the Atchison County Lake.
Atchison County Sheriff John Calhoon says Heaton then allegedly refused to drop his gun after repeated requests by the Deputy.
Eventually, Heaton complied and was taken into custody.
He faces two counts of aggravated assault and one misdemeanor count of criminal damage to property.
Heaton remains in the Atchison County Jail on 30 thousand dollars bond.
