Roger Hollister was in Atchison Monday so he could give a deposition in a wrongful death lawsuit filed by the children of Patricia Kimmi.
However, an Atchison County District judge granted a motion filed for Hollister for a continuance.
The lawsuit filed last September alleges that their father, Eugene Kimmi, conspired with two people, including Hollister, to kill her.
Kimmi was last seen alive on Nov. 6, 2009.
Her remains were found six months later on a farm near Sabetha.
The lawsuit claims Eugene Kimmi conspired with Roger Hollister and his wife, Rebecca Hollister, to cause Patricia Kimmi's death.
Roger Hollister was sentenced to life in prison in April 2011 for Patricia Kimmi's death. Rebecca Hollister and Eugene Kimmi have been questioned in the case, but never charged.
The lawsuit, filed in Atchison County District Court, seeks an amount of more than $75,000.
The suit alleges the defendants acted together to inflict physical injuries, mental anguish, pain and suffering and emotional distress on Kimmi and caused her wrongful death through a meeting of the minds.
A date to continue depositions hasn’t been set as of Tuesday.
Pre-trial motions in the case are to be heard Monday, June 25th at 1:30 p.m.
The jury trial is set to begin August 13th in Atchison County District Court.
