Water District Petition Deemed Invalid

(KNZA)--The petition submitted earlier this month by Brown County Rural Water District #2 for the annexation of property into its district has been deemed invalid. .

Deputy County Clerk Melissa Gormley told County Commissioners this week that the attorney for the Water District notified her office last Friday that the petition didn't meet the requirement of signatures from at least 50 percent of the landowners in the area to be attached.  Reportedly some of the signatures included multiple owners of the same property which only counts as one signature. 

A public hearing on the petition, which had been set for this upcoming Monday, has been postponed.  It will be rescheduled at a later date.     

Water District officials say they plan to gather additional signatures and re-submitted the petition.

The petition was submitted to the County Clerk’s office on August 6th—the second in an effort to annex property in the northeast corner of the county into the District in order to provide water service.    

The Water District had originally submitted a petition last month, but it was determined to be faulty by County Attorney Kevin Hill because it didn’t comply with state statute.

As a result, a new petition was drafted and re-circulated.
