(KAIR)--The first steps have been taken in the process of starting a re-trial for a rural Atchison County man convicted of murder in 2002.
Attorneys for 58-year-old Kirk Wilson appeared on his behalf in Atchison County District Court Monday afternoon along with prosecutor Steven Karrer from the State Attorney General's Office. Judge Martin Asher set a June 24th date for a bond hearing and pre-trial motions.
The Atchison County Court ordered a new trial for Wilson in 2013 in the March 2000 shooting death of 38-year-old Kurt Boldridge, saying that his counsel was ineffective. The state appealed the ruling, but it was upheld by a Kansas Court of Appeals panel in December of last year.
Boldridge was shot in the head with a shotgun as he slept at his rural Atchison home. Wilson was one of four people, including the victim's ex wife, Lisa Boldridge who was convicted of the crime.
Lisa Boldridge was initially handed a “Hard 50” sentence of life in prison in February 2001 after her first degree murder conviction in the case. However, a re-sentencing was ordered after the Kansas Supreme Courted ruled that “Hard 50” candidates should be sentenced by a jury and not a judge.
Her re-sentencing case has been continued multiple times since August of last year, but is scheduled to commence on November 3rd.
