KS Court Gives Another Chance For Hollister Lawsuit

(MSC News)--The widow of convicted murderer Roger Hollister gains another chance at a malpractice lawsuit filed against her husband's former attorney. 

That comes as a Kansas Court of Appeals on Friday overturned a previous ruling by a Shawnee County District Court that Rebecca Hollister was too late in her attempt to join the lawsuit against Topeka attorney James Heathman. The Court ordered the case remanded to Shawnee County District Court Judge Larry Hendricks for further proceedings. 

The Topeka Capital-Journal reports the lawsuit, filed by Roger Hollister prior to his death, seeks more than $1.5 million for a number of claims, including breach of contract.

Heathman represented Hollister during his Atchison County jury trial in connection with the murder of rural Horton resident Patricia Kimmi. 

Hollister was found guilty and was serving a life sentence at the El Dorado Correctional Facility when the 61-year-old died in March of 2013. 

His widow recently filed a lawsuit in connection with his death, alleging misconduct on the part of numerous state and local agencies.
