(KLZA) Falls City Police Chief John Caverzagie says his department has received complaints from citizens about trees, and people walking in the street.
The walking in the street issue came up late last fall and Chief Caverzagie has waited until the spring weather finally arrived to address the issue. The main issue is multiple walkers being side-by-side in the street and not moving over for traffic.
Under City statute where a sidewalk is provided and its use is practicable, it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway or shoulder. If a sidewalk is not available and a shoulder is available, any pedestrian walking along and upon a highway shall walk only on the shoulder as far as practicable from the edge of the roadway. If neither a sidewalk nor shoulder is available, an pedestrian who walks along and upon a highway shall walk as near as practicable to the edge of the roadway and, if on a two-way roadway, shall walk only on the left side of such roadway.
This is a reminder for walkers but should be noted that if not addressed, individuals could be cited for a violation and fined.
Chief Caverzagie is also reminding property owners of the clearance over streets and the sidewalk space for trees. A clearance of 8 feet must be maintained over the sidewalk space and a clearance of 12 feet must be maintained over the streets.
Property owners are responsible for the trees on their own property as well as the trees on the sidewalk space that abuts their property.
