(KAIR) -- Damages have been awarded to two Atchison County landowners for the unintentional drilling of rock on their property.
Atchison County District Court Judge Robert Bednar ruled in favor of landowners Willis Armstrong and Stephanie Prohaska in a civil suit against Bromley Quarry.
The court awarded a total of just over $127,000 to the landowners. However, the court ruled that quarry owner, Barbara Bromley, was not personally liable for the damages.
The Judge determined Bromley officials acted as a " good faith tresspasser" believing they lawfully on property they were allowed to be on.
Armstrong and Prohaska contended in the suit that the quarry trespassed and mined on their neighboring property near Sedgwick Road north of Atchison from 1992 until March 26, 2011 without their permission.
The lawsuit was filed in May 2011.
