(KAIR) -- An Atchison County civil trial involving a million dollar lawsuit against an area rock quarry wrapped up Tuesday afternoon.
The bench trial, involving property owners Willis Armstrong and Stephanie Prohaska's suit against Bromley Quarry began in late December, and was held for two days in Atchison County District Court. The trial was then continued.
Armstrong and Prohaska allege that the quarry trespassed and mined on their neighboring property near Sedgwick Road north of Atchison from 1992 until March 26, 2011 without their permission.
The lawsuit was filed in May 2011.
They also allege that mining on their property generated 855 thousand 500 tons of rock.
The suit seeks a total of $10 million--which includes the value of the mining on the property, plus damages.
District court documents indicate that District Judge Robert Bednar expects to rule on the matter within 30 days.
