Testimony Continues in 2001 Atchison Co Murder Appeal

(KAIR) --  Appeal proceedings commenced Tuesday in Atchison County District Court for a man convicted of premeditated first degree murder of a rural Atchison man in 2000.

Opening arguments and the beginning of witness testimony took place Tuesday morning in the case of Kirk Wilson.

He convicted in 2001 and sentenced to life in prison without parole for 25 years for the March 2000 murder of Kurt Boldridge.

Wilson’s new attorney team of Patrick Edwards, David Eberson and Victoria Smith are asking for either a vacated conviction or a new trial.

They claim that Wilson’s attorney during his trial, Michael Waite, who died in 2008, did not present sufficient evidence in the case.

The team says correspondence obtained from various witnesses was not submitted into evidence in the 2001 trial.

The team introduced dozens of exhibits of evidence into the appeal hearing Tuesday morning without objection from Rex Lane, who is representing the state in the case.

Lane was the Atchison County Assistant District Attorney during the time of the trial.

Testimony lasted much of the day and the bench trial is expected to continue Wednesday.

Atchison County Undersheriff Larry Myer, the lead investigator in the case, was on the stand testifying for three hours.

Wilson himself took the stand late Tuesday afternoon to testify.

Lisa Boldridge, who was Kurt Boldridge’s ex-wife, was sentenced to life without the possibility of parole for 50 years in February 2001 for her role.

Gary Skeen was given 14 years in June 2001 for conspiracy to commit first degree murder in the case, while John Goodpasture, Junior, was given two years of probation in June 2001 for conspiracy to commit aggravated burglary.

Wilson unsuccessfully tried to appeal his conviction in 2006 to the Kansas Supreme Court.
