In light of the recent legal and contractual hoops an Atchison couple has gone through in the past few months, they have started a petition to amend federal legislation on energy.
Wayne and Constance Hale have started a petition that encourages members of Congress to amend the Energy Improvement and Extension Act of 2008.
In the petition’s description, the Hales say many laws are created and amended to encourage consumers to invest in clean energy and get a 30% Federal Tax Credit.
They believe renewable energy companies use this incentive to get consumers to sign contracts.
However, when the company fails to abide by the terms of the contract, the consumer is left to battle the company in the court system.
The consumer has to hire a lawyer, petition the court, get a judgment, the consumers may or may not ever get their money back, and the consumer may lose their Federal Tax Credit.
The petition came about after the Hale’s looked into investing into a wind turbine at their property after an ordinance was passed late last fall by the city of Atchison.
However, the turbine contractor did not follow through with his terms of his contract and was sued by the Hales.
They won a Journal Entry of Default Judgment on March 9th.
However, the Hales say the contractor, Christopher Thompson, has not paid them to this date.
Thompson also owes several other civil judgments to other businesses and individuals.
The Hales lost their Federal Tax Credit, as well as over 28 thousand dollars during the venture.
They are looking to collect 100 signatures for their online petition.
